This agreement is between you and Smesh (referred to as “we” or “us”). These terms apply to all influencers, both registered and unregistered, listed in the Smesh database.

1. Agreement to Terms

Registered Influencers: By registering with Smesh or creating an account, you accept and agree to comply with these Terms of Use. You confirm that you have read, understood, and accepted these terms, with no modifications or reservations.
Unregistered Influencers: If you are an unregistered influencer, meaning your information is collected by Smesh from public social media sources like Instagram or YouTube, by accessing or interacting with Smesh or its users, you accept these Terms of Use. Smesh will treat you as an influencer under these terms.

2. Services Offered by Smesh

Smesh is a platform that connects influencers with brands, advertisers, and marketing agencies. By joining Smesh, you acknowledge that you may receive requests from brands to promote their products or services on your social media channels in exchange for compensation. You have the freedom to accept or reject such requests. Smesh only serves as an intermediary and does not provide any guarantees regarding the brands or agencies.

3. Data Collection and Use

Smesh collects publicly available information from social media platforms like Instagram and YouTube to showcase your creativity, social media presence, and engagement to potential brands and agencies. This data may include your profile information, social media activity, and audience engagement metrics.

We may use Application Programming Interfaces (APIs) and web crawlers to collect and monetize your publicly available content. The goal is to help you connect with brands and monetize your online presence. However, Smesh does not endorse or verify the content of the brands, agencies, or marketing campaigns that may contact you.

4. Verification

If Smesh verifies your account, the “Verified” status only means you have completed the verification process. It does not indicate any endorsement by Smesh of your content or profile.

5. Unregistered Influencers

If your name appears in the Smesh database as an unregistered influencer and you do not want it listed, you can request removal by contacting us. If there are any inaccuracies, you may request corrections, and we will address them promptly.

6. Compliance with Indian Laws

Smesh is a platform intended for Indian users and is designed to comply with Indian laws. If you are accessing Smesh from outside India, you acknowledge that Smesh may not comply with the laws of your country. It is your responsibility to ensure that your use of Smesh complies with local laws, rules, and regulations.

7. Content and Data Security

You understand that your content may be transmitted over various networks, and changes may be made to adapt to technical requirements. While Smesh takes reasonable security measures, we do not guarantee that your content will be secure from unauthorized access or loss.

8. Third-Party Links

The Smesh platform may contain links to other websites. These sites have their own terms of use and privacy policies. Smesh is not responsible for the content or practices of third-party sites. You should review the privacy policies of any linked websites before submitting your personal information.

9. Cookies

Smesh uses cookies to track website usage and traffic. By using the platform, you consent to the use of cookies. If a third party accesses Smesh through your device, you must ensure they understand and agree to these terms.

10. Marketing and Communications

Smesh may use your name or business name for marketing or promotional purposes.
